What if I have Priors?

If you have prior convictions, the penalties increase significantly.

For a second offence, the minimum penalties are:

  • A two year driving prohibition anywhere in Canada under the Criminal Code
  • A three year suspension in Ontario of your driver’s licence if your last prior conviction was within 10 years (note that there are reciprocal agreements in most, if not all, the provinces and Territories in Canada)
  • A minimum jail sentence of 30 days

For a third offence, the minimum penalties are:

  • A three year driving prohibition anywhere in Canada under the Criminal Code
  • A lifetime driver’s licence suspension in Ontario (if your last conviction was within 10 years)
  • 120 days in jail
